1. Who we are

Hystoriq Portraits is the registered business name of Giacomo Guerrini, sole trader, Apt. 22, Block 1, Island Key, East Road, East Wall, Dublin 3, D03 CA33, Ireland (email info@hystoriqportraits.com, VAT number IE2252072LA, business name registration no. 768696). In these terms, "we" and "us" means Hystoriq Portraits and "you" means the customer.

2. How the portrait lab works

  1. You choose a costume and upload a photo of one person.
  2. Automatic checks look at the photo, for example to confirm that it shows one adult face clearly and contains nothing unlawful or unsafe. If a photo doesn't pass, no portrait is made.
  3. Our AI tool creates a preview of the person in the costume. Previews carry a "Hystoriq Portraits preview" watermark. You can make another try or use another photo, within the limits shown on the site.
  4. If you like a preview, you choose the format, frame and size and add it to your cart. Your print and your digital file will match the preview you chose, without the watermark.

Previews are free. The number of free previews is shown on the site and may change. Free previews have no cash value and can't be exchanged or transferred.

3. Your photos: what you confirm

By uploading a photo you confirm that:

  • you are 18 or older;
  • the person in the photo is an adult, and you have their permission to use their photo for this portrait (or it is you);
  • you have the right to use the photo.

You must not upload photos of children, of public figures or celebrities, or anything sexual, violent, hateful or unlawful. You must not use the lab to make an image meant to deceive, harass or harm anyone. We may refuse a photo or an order, or cancel an order and refund it in full, if we reasonably believe these rules have not been respected. Automatic checks can stop a photo by mistake: if that happens, write to us.

4. AI-generated images

Portraits are made with AI. They are interpretations, not exact photographs, so small differences in likeness, skin tone, hair or hands are normal. You see the preview before you buy, and what you approve is what we print. The portrait shows a real person's face in an invented historical setting: please don't present it as a real historical photograph.

5. Accounts

You can sign in with a Shopify customer account. We send you a code by email, so there is no password. Signing in links your free previews and your portraits to your account. Please keep access to your email secure.

6. Prices and payment

Prices are shown in your currency in the shop and at checkout. For delivery to Ireland, prices include Irish VAT. Delivery is free to every country we ship to. Your country may charge import taxes, duties or handling fees on delivery; these are not included in our price and are paid by the recipient (see our shipping policy). Payment is taken at checkout by Shopify's secure checkout, with the methods shown there.

7. Your order

Your order is accepted when you receive our order confirmation email. Every order is checked by hand before it goes to print, usually within 2 business days. If we find a problem (for example the file isn't good enough to print at the size you chose), we will contact you. If it can't be fixed, we will cancel the order and refund you in full.

8. Delivery

Prints are produced and shipped by our print partner, with tracking, to the address you give at checkout. Delivery times are in our shipping policy. The risk of loss or damage passes to you only when you, or someone you name, receive the parcel.

9. Digital file

Every print order includes a free high-resolution digital file of your portrait, which we email to you as a download link after your order has gone to print. The digital file is for your personal, non-commercial use: you may print it for yourself and share it with family and friends, but not sell it or use it in advertising.

10. Cancellation and returns

Each portrait is made to your choices and personalised with your photo. Under Irish law (Consumer Rights Act 2022, section 111) the 14-day right to cancel does not apply to it, and we don't accept returns for a change of mind. As a goodwill gesture, you can still cancel free of charge until we send your order to print: email us as soon as possible. Your rights when something is faulty or damaged are explained in our refund policy and are not affected.

11. Faulty or damaged items

See our refund policy. Nothing in these terms limits your statutory rights as a consumer.

12. Our use of your portrait

We do not use your photo or your portrait in our marketing unless you give us separate permission.

13. Liability

We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care. We are not responsible for loss that was not foreseeable, or for business losses, since our products are for personal use. Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or your statutory rights as a consumer.

14. Law and complaints

These terms are governed by Irish law. If you are a consumer, you also keep the protection of the mandatory consumer law of the country where you live, and you can bring proceedings in the courts there or in Ireland. If you have a complaint, write to info@hystoriqportraits.com and we will do our best to put it right.

15. Changes

We may update these terms. The version that applies to your order is the one shown when you placed it.
